Dear Health Conscious American,
Sometimes, in the middle of an intense battle, an opportunity crops up unexpectedly, where seizing it can turn the tide of events. A phenomenal opportunity has arisen in the battle to prevent ratification of the pro-illness CODEX ALIMENTARIUS Vitamin and Mineral Guideline!
I will first explain to you what that opportunity is, and then I invite you to join me in taking action to take advantage of this opportunity.

U.S. CODEX Office Policy on CODEX ALIMENTARIUS is
Illegal
|
|
As I've explained in my
blog, the U.S. has declared its intent to support the restrictive, illness-promoting CODEX ALIMENTARIUS Vitamin and Mineral Guideline
(VMG) at the CODEX ALIMENTARIUS meeting in Rome next month, despite the fact that this position is
illegal under U.S. law. Title 19 USC 3512 prohibits America from harmonizing with any international standard that violates U.S. laws. The CODEX Vitamin and Mineral Guideline would violate DSHEA (the 1994 law which treats supplements as foods).
As a result of
DSHEA, no upper limit can be set for nutrients in the US and thus CODEX would violate this law (because CODEX would set upper limits for nutrients).
The U.S. Government was notified by our Citizen's Petition, which the Natural Solutions Foundation submitted on June 1, 2005, that it is
illegal for the U.S. Codex Office to support ratification of the CODEX ALIMENTARIUS Vitamin and Mineral Guideline
(VMG).
A Citizen's Petition is not a conventional petition. It is a powerful legal tool to compel action on the part of the U.S. Government to follow its own laws and to lay the groundwork for further legal action if the Government does not change course.
Despite our Emergency Citizen's Petition, which so far as not been answered, Dr. Ed
Scarbrough, head of the U.S. CODEX Office, unfortunately announced that the U.S. CODEX Office has chosen to stand firm on its illegal pro-illness, pro-CODEX Vitamin and Mineral Guideline position, scheduled for ratification in Rome, Italy, July 4-9, 2005.

Natural Solutions Foundation Will Take the U.S. CODEX Office to Court
|
|
Regardless of whether the U.S. CODEX Office chooses to heed the legal warning of our Citizen's Petition, the petition itself has been filed and now allows a serious legal suit to be unleashed upon the U.S. CODEX Office, should they actually proceed to push to ratify the tyrannical and, in the U.S.,
illegal, CODEX Vitamin and Mineral Guideline.
But something incredible just happened this past week that makes it easier for us to protect health freedom (on behalf of the American people) against the
illegal policy of the U.S. CODEX Office.

The CODEX Vitamins and Minerals Guideline Could be Delayed by One Year Due to CODEX's Own
Bureaucracy!
|
|
Out of the blue, three countries, China, Australia and Venezuela, have suddenly announced that they will be pushing for small, bureaucratic changes in the VMG before its ratification next month in Rome, even though they are not opposing the
VGM.
|
|
The changes they are requesting are single words here and there, and it seems that they are serious about the changes going through.
Here's the incredible part of this sudden event: the pressure by China, Australia, and Venezuela to make changes to the wording of the CODEX documentation could send the VMG back to committee for further revision! This could delay the ratification of the destructive CODEX Vitamin and Mineral Guideline by up to (or even more than) one year!
That could buy us in the health freedom movement at least a year (or more) before the next meeting for ratification by the CODEX ALIMENTARIUS Commission!
Such a period of time will make it much easier for us to prevent the United States of America from pursuing or implementing its current illegal policy of support for the CODEX Vitamin and Mineral Guideline!
This is good news folks.

Your Action is Vital
|
|
You play a vital role in helping to change the illegal U.S. policy of support for the dangerous VMG, which, if ratified, could end natural health options here in the U.S. You can take action by simply asking Congress to change U.S. CODEX policy from the current illegal position of supporting the VMG, to pushing for it to go back to committee (and thus putting it up for authentic review by serious scientists and lawyers, who with more time, will no doubt make it impossible for the U.S. to support the VGM, simply because the VGM is unscientific and goes against the laws of our country).
We must get Congress on our side. Many of them are not even aware of the illegal policy of the U.S. CODEX Office, and many would no doubt be outraged if they found out.
If enough Americans like you take action and make Congress aware of the illegal intentions of the U.S. CODEX Office (I will tell you shortly what to do), and the CODEX VMG is pushed back one year, you can be sure that we at Natural Solutions Foundation will make very, very, very good use of that year!

Because treating nutrients as toxins allows CODEX to dictate upper limits for nutrients, and thus, limit their availability in the marketplace (which would be a boon for the pharmaceutical industry). The
Codex Alimentarius Commission, the active arm of the United
Nations Food Standards Programme, is currently in the process of
completing a controversial global guideline on the manufacture
and sale of nutritional supplements. However, the drafting of
this text, the Draft Guidelines for Vitamin and Mineral Food
Supplements, has not been carried out in accordance with the
rules set out in the Codex Procedural Manual (14th
edition), and the Guidelines are therefore defective.
|
|
Drafted
by the Codex Committee on Nutrition and Foods for Special
Dietary Uses (CCNFSDU), the Draft Guidelines for Vitamin and
Mineral Food Supplements advocate similar restrictions on the
sale of nutrients to those contained in the EU Food Supplements
Directive, which itself was recently rejected as invalid by
Advocate General Geelhoed of the European Court of Justice in
Luxembourg.
Specifically,
paragraph (b) (page 57) of the Codex Procedural Manual,
dealing with DRAWING UP OF CODEX STANDARDS (under GUIDELINES
ON THE CONDUCT OF MEETINGS OF CODEX COMMITTEES AND AD HOC INTERGOVERNMENTAL
TASK FORCES), states that:
|
| ”…
all standards and related texts should have a preface
containing … a brief description of the scope and
purpose(s) of the standard or related text,” |
|
|
This
requirement was established at the 19th Session of the Codex
Committee on General Principles, held in
Paris
between 17-21 November 2003, and then adopted at the 27th
Session of the Codex Alimentarius Commission, held in
Geneva
between 28th June and
2nd July 2004
. The CCNFSDU subsequently met in
Bonn
from 1-5 November 2004 (26th Session), but did not take proper
account of this requirement when considering the guidelines,
as evidenced by both the text of the guidelines and the
CCNFSDU’s report of its 26th session:

Neither
the Preamble nor the Scope of the Guidelines for Vitamin and
Mineral Food Supplements contain any statement to indicate the
purpose(s) of the text.
Given
therefore that Codex texts have been used by the World Trade
Organization as the benchmark in international trade disputes,
and moreover that it is expected that they will be used
increasingly in this regard, it is therefore of crucial legal
importance that the question “What is the purpose of the
guidelines?” should have a clear, easily understandable
answer, and moreover that this should be provided in the text.
|
|
The
CCNFSDU’s Report of its 26th Session gives no indication
that the requirement for the preface to contain a description
of the purpose of the text was even considered,
despite
the fact that the matter was raised at this session by the
delegations of
South Africa
,
Tanzania
, and the National Health Federation.
|
|
With
the above in mind, it is now clear that the 28th Session of
the Codex Alimentarius Commission that will be meeting in Rome
from 4-9 July 2005 has no option but to refer the Guidelines
for Vitamin and Mineral Food Supplements back to the
CCNFSDU, in accordance with the GUIDE TO THE
CONSIDERATION OF STANDARDS AT STEP 8 OF THE PROCEDURE FOR
THE ELABORATION OF CODEX STANDARDS INCLUDING CONSIDERATION OF
ANY STATEMENTS RELATING TO ECONOMIC IMPACT, as described
on pages 26-27 of the Codex Procedural Manual (14th
edition). As such, until such time as the CCNFSDU’s
written comments regarding this matter have been received and
considered by the Codex Alimentarius Commission, the Codex
Guidelines for Vitamin and Mineral Food Supplements should
not, and indeed, cannot, be advanced beyond Step 8 of the
Procedure. To act otherwise would be for the Commission
to violate its own rules of procedure.

Last week I went to a "Codex" conference in Washington DC. There a large and, so far, loosely knit coalition was formed to exchange information. We began to coordinate the battle to stop the Big Pharma controlled European Union from inflicting "Codex Alimentarious" health standards on the rest of the world.
It will take me some time to absorb all of the information I heard, and read, but for now, let me make something clear - "Codex Alimentarious" is a plot to inflict "the German Model" of health care on all of Planet Earth. The primary targets are Europe (almost completed), Australia, New Zealand, Canada, and the United States.
The plot was hatched in Germany, I believe, and frankly, reeks more of a "world domination" scheme than a movement towards standardizing health care on Planet Earth.
The group formed in Washington will focus on crushing the attempt to harmonize North American laws with "Codex," thereby preventing "the German Model" of health care from becoming the law of the North American continent.
Did I actually say "World Domination?"
Yes, I did. For good reason.

NEW GERMAN REPORT CLAIMS THAT FOOD SUPPLEMENTS ARE UNSAFE

Dear friends:
As I have pointed out before in this venue, the Germans are engaged in a "take no prisoners
war" against people's right to maintain their health.
The debate around CODEX is fundamentally an attempt by
BIG PHARMA, directed by the German industry, to preclude the availability of adequate amounts of nutrients capable of keeping people healthy.
Collective health is the economical enemy of
BIG PHARMA.
If they win we all loose! Support the ANH law suit

A newly established German institution, the Federal Institute for
Risk
Assessment (BfR), released yesterday a 341-page report [1] on
risk
assessment of nutrients used in food supplements. The report
makes
recommendations for maximum levels that are well below those
that are commonly present in vitamin and mineral supplements
sold in health stores in the UK, Ireland, Sweden, other EU
countries, the USA and elsewhere. Many people might,
understandably, assume, as a result of this report, that
commonly availablefood supplements are unsafe.
The Alliance for Natural Health (ANH), a pan-European body of
interests in the natural healthcare field, strongly contests the
science used by the German institute. Good science and good law
underpin all of the ANH's work, and the scientific reports
produced by the ANH are endorsed by many of the world's leading
doctors and scientists working in the field of nutritional
medicine.
The report, for example, recommends a maximum level of vitamin C
of 225 mg in food supplements, when many health stores sell 1000
mg tablets, and significant numbers of people consume 2000 mg or
more per day. Maximum recommended dosages for vitamin B6 have
been set at 5.4 mg, against 25 mg or more commonly found in UK
and USsupplements, while vitamin B12 has been set at an
astonishing 9 mcg, compared with over 300 mcg in many
supplements.
Many European countries have for years considered multiples of
Recommended Dietary Allowances (RDAs) for nutrients as a means
of
assessing safety, but this approach has been found to be
scientifically unjustifiable as RDAs are minimum levels that
guard against the development of deficiency diseases that are
uncommon in modern, western societies, such as scurvy, beri-beri,
pellagra and rickets. Scientific risk assessment is the recently
acclaimed approach that will replace RDAs for evaluation of
safety, having been endorsed both by the European Union in its
Food Supplements Directive, set to come into force in August
this year, and the United Nation's Codex Alimentarius, which
develops global guidelines for food safety.
Dr Robert Verkerk, executive director of the ANH says:
"The maximum levels for vitamins and minerals proposed by
BfR are in many cases far lower than those required for optimum
health. They have used what is purportedly a scientific method,
to produce data that is meaningless for the majority of the
population.
"The problem is that the poor science used in this report
will be viewed seriously by EFSA - the European Food Safety
Authority - that is developing maximum levels for use in food
supplements across in Europe, and Codex Alimentarius, which is
setting global guidelines on vitamins and minerals. In the worse
case scenario, the science could be adopted by EFSA lock stock
and barrel and that would be catastrophic for the leading edge
of the natural products industry in Europe, as well as US
innovative suppliers, practitioners and consumers of these
products."
In December 2004, the ANH submitted a ground-breaking critique
[2] of risk assessment methods to the FAO/WHO of the United
Nations in response to a consultation on the subject. The ANH
report demonstrated the flawed nature of existing scientific
risk assessment methods used by the EU's Scientific Committee on
Food, in turn used as the baseline for upper levels by BfR. BfR
have gone on, as proposed in the EU's Food Supplements
Directive, to reduce further the already unnecessarily low
'upper safe levels' by taking into account dietary intakes and
susceptible population groups, and ended up with meaningless,
unreasonably low maximum recommended levels for food
supplements.
The ANH's landmark case against the EU's proposed ban on 75% of
vitamin and mineral forms currently on the UK market is due to
be heard in the European Court of Justice in Luxembourg on 25
January.

Dietary Uses started with a nasty shock, something that we were
all expecting, but not this year.

THIS
YEAR’S CODEX COMMITTEE MEETING ON NUTRITION AND FOODS FOR
SPECIAL DIETARY USES STARTED WITH A NASTY SHOCK, SOMETHING THAT
WE ALL WERE EXPECTING BUT NOT THIS YEAR. DR. CHRISTINE TAYLOR OF
THE FDA, NOW ON ASSIGNMENT TO THE WORLD HEALTH ORGANIZATION IN
GENEVA, ANNOUNCED THE FORMAL OPENING OF A NEW JOINT FAO/WHO
PROJECT. THE JOINT FAO/WHO DEVELOPMENT OF A SCIENTIFIC
COLLABORATION TO CREATE A FRAMEWORK FOR RISK ASSESSMENT OF
NUTRIENTS AND RELATED SUBSTANCES. BEHIND THIS FANCY TITLE LURKS
AN OMINOUS PROJECT – THE CREATION OF A FRAMEWORK RISK
ASSESSMENT MODEL TO GOVERN THE ASSIGNMENT OF UPPER LIMITS (ULs)
TO VITAMINS AND MINERALS AND PRESUMABLY OTHER NUTRIENTS AS WELL.
SOUND LIKE PROGRESS? IT IS NOT! BASED ON THE PROJECT DESCRIPTION
SO FAR, THE CURRENT PROPOSAL ENVISIONS:
•
going forth to set ULs on vitamins and minerals using expanded
uncertainty factors, a fan name for guesswork even where the
data is unclear,
•
setting levels based on intakes calculated on the basis of both
maximum supplementation and food source consumption of nutrients
and then setting the Upper Limits low enough for the general
population to protect even the most sensitive (sensitive to over
exposure to nutrients) within the generally applied upper intake
levels.
This
is bad, bad news indeed and probably much worse than the general
health freedom oriented observer at Codex realized since a
little-known wrinkle within the Sanitary Phytosanitary Agreement
allows the WTO to pick the international organization that sets
these standards. In other words, it could be this joint FAO/WHO
committee without reference back to Codex.
Or,
equally bad, it could be this joint FAO/WHO Committee then
referring back its framework to another entity within the Codex
immediate parent, the Joint FAO/WHO Food Standards Programme,
that entity then acting in concert with Codex in the final
stages of risk management under the guideline finalized at
CCNFSDU this week (to be adopted by the full Codex Commission
next summer.) Yes, it’s confusing, but international
bureaucracies often are! The point is whether they take path A
or path B, the news seems equally grim and equally imminent.
This is true in part because on Tuesday of this week, the USA
caved in on disputed language in part 3.2.2 of the proposed
draft guideline for vitamin and mineral food supplements. As now
agreed, the guideline’s part 3 on contents of vitamins and
minerals, maximum amounts now contains three dangerous pegs:
•
first, the statement that safe upper levels per daily portion
shall be based on scientific risk assessment. That is a

victory, namely, that in setting upper levels, both nutrients
consumed from standard food sources and nutrients consumed from

counted together in order to suppress general upper levels to
protect the sensitive consumer.
• and third, that when maximum values are set, regulators may
use relatively low levels established in population reference
values as part of the UL setting process. While the FDA claims
this latter is acceptable compromise language, don´t you
believe it!
While
only the third peg is new as of this meeting, the changed
meaning of the first two ’scientific risk assessment’ and
‘other dietary sources’ is new, too, thanks to the unveiling
of the new joint FAO/WHO project discussed above. Could it
possibly get any worse? Yes, and it will unless intelligent
concerted action is taken now.

My dear friends,
The time has come to realize we live in a global village and it is much better to join force with our friends abroad and avoid slaughter in our soil.
It took Woodrow Wilson a great deal of convincing to make America join the
European allies in the First World War and it took Pearl Harbor to allow Roosevelt to finally join the Brits in Europe to fight Hitler.
History seems to repeat itself. The belligerent German war machine, via their pharmaceutical cartel, is again leading the way to take control of the natural field of medicine. They kill first and then set their rules and prices.
Germany is the host country of the UN Codex Alimentarius Commission's Committee on Nutrition and Foods for Special Dietary Uses which could finalize a global trade standard for vitamins and minerals in November 2004. The USA has already been set up to lose in a future WTO Trade Dispute on the Codex vitamin issue via a whitewashed congressional oversight hearing on March 20, 2001.
It was not too long ago when the German Jews refused to see their life at risk in Nazi Germany! We are now all at risk.
The alternative medical

You might have been asked to focus on the Durbin proposed legislation
That is a waste of human resources. The Durbin Bill is going no where
(only 4 cosponsors, most recent was 7 months ago) and in fact his multiple attempts to find more cosponsors have failed. There are only 100 members in our Senate and they are well aware of the fact that there are over I39 million of us that use supplements.
We can therefore put this issue to rest and focus on the immediate danger, that of the passage by the European congress of the very restrictive supplements regulations, which unless overturned in court will be transposed into the Global Trade Standard at Codex.
Let’s make a wise use of our money by joining our allies in the
imminent fight in the European courts.
The ANH (www.alliance-natural-health.org) is very effectively working in this arena.
